This is Anita from Real Estate Crunch.
0:11
You know, one of the things that a lot
0:12
of people they think about when they
0:13
look at real estate, they say, "Oh, you
0:15
know, I want to be able to do real
0:17
estate, but without a real estate
0:19
agent." Fine. If you want to buy a home
0:21
on your own without the real estate
0:22
agent, you can. But if your friend wants
0:25
you to sell their home or your neighbor
0:28
says, "Hey, you're a great salesman. Can
0:30
you help me sell my home?" Then that is
0:33
a whole other and different story. We're
0:36
going to talk today about some of the
0:37
risks of unlicensed real estate deals.
0:40
Because there's a lot of people that
0:40
think that, oh, this should be no big
0:42
deal. I should just be able to do it.
0:44
But the truth is, there are some very
0:46
defining rules when it comes to real
0:48
estate. You know, if you've ever sort of
0:50
like thought about like, oh, I could
0:51
sell my neighbor's home. When you say to
0:53
your neighbor, "Oh, let me sell your
0:54
home for you." And you're not a licensed
0:55
real estate agent. That actually is not
0:58
legal. You need to be a licensed real
1:01
estate agent in order to buy or sell
1:04
property. It is not legit. And this
1:06
might surprise a lot of people because
1:08
they might think, well, this doesn't
1:09
really matter at all. But, you know, in
1:11
in almost all states, and I believe it
1:13
is all states, that you need to have a
1:15
license. You have need to be a licensed
1:17
real estate agent. And each state has
1:20
different boards and different things
1:21
that you must do to become a real estate
1:23
agent. So if you really want to sell
1:25
that neighbor's home of yours, first get
1:28
your license and then you can do it. You
1:31
know, so that is really important. There
1:33
can be a lot of financial and profession
1:35
um professional repercussions if you try
1:38
to do this. You know, stepping the world
1:40
of real estate can be can seem thrilling
1:42
at time, but you know, the shortcuts in
1:45
the industry can lead to a dead end.
1:48
Diving into real estate transactions
1:50
without proper license isn't just
1:53
rulebending. It's a recipe for disaster
1:55
for your finances and career and for
1:58
your own career. And this could really
2:00
impact you in other areas of your life.
2:03
If you begin to try to circumvent the
2:05
licensing rules, you could face, you
2:07
know, you could face hefty fines, you
2:08
know, thousands of dollars worth. And
2:11
you could also be sued, you know, by the
2:13
by the buyer or other people if it's not
2:16
an actual transaction that you're
2:18
supposed to do. You could actually go
2:19
down to as, you know, trying to scam or
2:22
trying to scam somebody out of their
2:24
property. That's one of the reasons why
2:28
they have real estate agents is to
2:29
protect the buyer and the seller. And so
2:33
if you decide that you want to try to
2:35
buy and sell, you're going to try to buy
2:37
and sell a property. If it's your own
2:38
property, you of course and you own the
2:41
property, you are legally allowed, you
2:43
know, to do your sellers, you know, sold
2:45
by the owner. But if it's not your
2:48
property, and if you're not the owner of
2:50
the property, and even if it's your
2:52
parents' property, your cousin's
2:54
property, your next door neighbor's
2:55
property, and you are not an agent, you
2:58
are not legally allowed to sell by
3:01
owner. Of course, you could, you know,
3:03
advise somebody, you could help
3:04
somebody, you know, or if they wanted to
3:07
sell by owner, you you could, you know,
3:09
advise and help them, but you yourself
3:15
able to act as an agent. And the reason
3:17
is is there's some ethical
3:18
considerations and it's for the
3:21
consumer's protection. If I'm going into
3:26
and um I'm considering to buy a home and
3:30
the person I'm talking to, you know,
3:31
there's the owners there and then I'm
3:33
talking to what I think is the real
3:36
estate agent and I have my real estate
3:38
agent there and we think we're
3:40
negotiating between the two real estate
3:42
agents with the owner and we're not. you
3:45
know that of course has ethical concerns
3:47
and can be concerns also of a scam or
3:50
fraud. So there can be all of those
3:52
concerns you know with that you know so
3:54
it's really essentially not good to do
3:57
and is not legal and it goes back again
3:59
that if this is something that you
4:01
really want to do if you really want to
4:03
be able to buy and sell real estate then
4:05
go and get your license and become board
4:07
certified. In a lot of states it's not
4:09
that difficult. You need to do some
4:12
coursework. You need to take an exam and
4:15
you can become a a licensed real estate.
4:18
A lot of people, they sell real estate
4:20
while doing their full-time job. They
4:23
might do real estate on the side. They
4:25
might become a real estate agent just
4:26
because they're, you know, interested in
4:28
real estate. You can do it for all those
4:30
different reasons, but do not say that
4:32
you are a real estate agent and try to
4:35
buy and sell property if you are not. My
4:38
co-author James Johnson has written a
4:41
blog on this entitled Risks of
4:43
Unlicensed Real Estate Deals if you'd
4:45
like to be able to read more on this.
4:46
But we um highly recommend and we highly
4:49
stress that if you are not a real estate
4:52
agent, do not try to pose as one and do
4:55
not try to buy and sell property without
4:57
the proper um legal documentation to be
5:01
able to do so. This is Anita from uh
5:04
Real Estate Crunch. Thank you so much
5:06
for listening. We will put a link to
5:08
James Johnson's blog post in the
5:10
description uh below if you'd like to be
5:12
able to read more on this. And um if
5:15
you'd like to be able read more on
5:16
there's lots of this on the internet and
5:18
check with your own state. You know, if
5:20
you're if you're not sure, call your own
5:23
um state and they can tell you exactly
5:24
all the rules on this, but um the main
5:28
rule is that real estate you have to be
5:30
a boardcertified real estate agent to be
5:33
able to sell real estate. Same way that
5:35
if you go to a doctor, you want to make
5:37
sure the doctor passed the board. If you
5:39
go to a medical facility, the nurse has
5:41
or if you're working with an accountant
5:43
that the accountants has passed the
5:44
board that you know, all of these
5:46
different things they that they're all
5:47
board certified for a specific reason
5:50
and real estate is one of those. Thank
5:53
you so much for listening and being part
